Security Deposits Under New Mexico Law.

Under New Mexico's "Uniform Owner-Resident Relations Act," if a lease agreement is for one year or less, then a landlord's security deposit may not be higher than one month's rent. If the lease agreement is for more than one calendar year, the landlord's security deposit may only be higher than one month's rent if the landlord holds the security deposit in an interest-bearing account. When the tenant vacates the premises, the landlord must return the security deposit, plus any accumulated interest, to the tenant.
